Terms and Conditions of Sale
Please read the following agreement carefully
1. Defined Terms
"Discount Office" means EP Trading Ltd, whose head office is at Unit 30, Monckton Road Industrial Estate, Wakefield, West Yorkshire WF2 7AL trading as Discount Office and Discount Office.co.uk. Discount Office is a division of EP Trading Ltd number 2968336, VAT No. 656 2240 45. Registered office: Unit 30, Monckton Road Industrial Estate, Wakefield, West Yorkshire WF2 7AL. "Terms" means these terms and conditions of sale. "Products" means any products listed on Discount Office websites for which you place an order which is accepted by Discount Office. "You", “buyer” or “customer” means you, the customer.
hese Terms govern the sale of goods by Discount Office. Note that Discount Office’s websites are intended for UK business users only, and Discount Office reserves the right to refuse service and cancel orders to non-business customers. No other terms and conditions shall apply. Submission of any order using Discount Office websites shall be deemed to constitute acceptance of these Terms.
2. Orders
Orders can be submitted anytime at www.discountoffice.co.uk or by phone on 01924 369169. Although we aim to process all orders same day, orders sent after 5:00pm or on weekends and Bank Holidays will not be processed until the next working day.
By placing an order you warrant that you are a business user. All orders placed by you are subject to acceptance by Discount Office. Discount Office reserves the right to revise prices, limit quantities, correct errors in its website pricing or descriptions and refuse orders at its discretion without limitation.
If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on the Site is incorrect for any reason, we will contact you upon discovery of the error to let you know the correct price and ask you whether you still wish us to fulfill your order at this price. We shall be under no obligation to fulfill an order for a product which was advertised at an incorrect price. Should we have fulfilled the order before discovering the error, we reserve the right to take back the goods and refund you the purchase price or charge you the correct amount.
Except as may otherwise be permitted by applicable law, you may not cancel an order which Discount Office has accepted without the agreement in writing of Discount Office, which requirement may be waived by Discount Office from time to time in its sole discretion. Ownership and title remains with Discount Office until full payment for products has been received.
3. Delivery
We aim (but do not guarantee) to deliver all orders for UK mainland the next working day, although certain items such as furniture may take longer (see below). Discount Office cannot be held responsible for any consequential loss due to late or non-delivery.
Note that oversized or bulky items may require additional delivery time and some products are delivered to customers directly by the manufacturer. Discount Office shall Endeavour to inform you of extended delivery times at the time you place your order. In any case, Discount Office shall not be liable for any cost or damage caused by late or non-delivery of the Products. Any delay in delivery of the Products shall not give you a right to reject the Products or cancel your order. Discount Office reserves the right to deliver the Products in installments.
Furniture installation using Discount Office’s professional installation service will be carried out at a time agreed by both parties. It is the customer’s sole responsibility to ensure that the intended site, and access to it, is clear and prepared for installation. A charge will be made for follow up visits necessitated by access restrictions or incomplete site preparation. Where office furniture is left at a customer’s premises pending revisit for installation, Risk of damage or loss of the goods shall pass to the Buyer at the point of delivery who will be solely responsible for their safekeeping.
Delivery times are between 8.00 am and 5.00 pm and a signature will be required on delivery. The delivery driver needs to obtain a signature for all parcels. Please state when ordering the floor level of your delivery address if it is not at ground level. For larger organizations, please note that our obligation is to deliver to main reception, stores or post room only.
Delivery to the UK mainland is free on all orders over £40.00 (ex VAT). Deliveries to NI, Highland and Islands and other remote regions may take longer. Additional carriage costs may also apply to these areas and you will be advised at time of order if this is the case. Please note we cannot deliver to PO Boxes or BFPO addresses.
4. Payment
Unless you are a Discount Office Business Account Holder, you must pay for the Products at the time you place your order. If paying by credit card please note: If you require the goods to be delivered to an address other than that to which your credit card is registered, we may need to verify your details before we can process your order.
Goods are supplied to Business Account Holders on the following payment terms:
The Buyer shall pay the price of the goods within 30 days following the end of the month in which the goods supplied were invoiced by the Company notwithstanding that the property in the goods has not passed to the Buyer. The Company reserves the right to grant, refuse, withdraw, restrict, alter, suspend or cancel credit terms at their sole discretion. The Company, without limitation, reserves the right to refuse or cancel orders for goods where the buyer is or is liable to become in breach of its agreed credit terms. If the Buyer fails to make payment on the due date then without prejudice to any other right or remedy available to the Company, the Company shall be entitled to charge the Buyer interest and compensation pursuant to the Late Payment of Commercial Debts (Interest) Act 1998 as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002. The Company may transfer information about the Buyer for any or all of the following purposes; to obtain credit insurance, to undertake credit control and to securitise debts. The Company may make credit reference agency searches in respect of the Buyer’s business and its principals.
5. Returns
We aim to make the return of unwanted goods as uncomplicated as possible. Just call 01924 369169 or email returns@discountoffice.co.uk to arrange free collection and full credit subject to the terms set out below.
You can return unwanted items within 7 days of delivery. If you contact us within 7 days we will collect the items free of charge and issue you a full credit. Thereafter, the return of unwanted goods is entirely at the discretion of Discount Office and the minimum charge for collection is £4.95 (which will be deducted from the value of your credit). In all cases the goods must be unused, complete, and in ‘as new’ condition and in their original and unmarked packaging. Laptops, selected business machines and software, food and drink, made-to-order and personalised items, installed furniture and seating are non-returnable at any time.
Once the goods have been received back into our warehouse and their condition checked, you will receive a full credit for returned items subject to the conditions above. Just call our Customer Services Team on 01924 369169 or email returns@discountoffice.co.uk to arrange collection.
All credits exclude original delivery charges, if applicable.
6. Damaged, Missing or Faulty Items
If any items are damaged or missing from your order, please contact us within 3 working days of your delivery on 01924 369169.
If a technology product appears to be faulty, we shall provide you with a telephone contact number for the manufacturer to confirm the nature of your fault and obtain a fault acknowledgement reference from them. Please note we are unable to accept technology returns without this. Once you have the reference, please contact us on 01924 369169 or email returns@discountoffice.co.uk us so we can arrange collection.
7. Warranty
Subject to the limitations on its liability set out in these Terms, Discount Office warrants that the Products will be free from defects in material and workmanship for a period of one year from the date of delivery. Discount Office shall be under no liability in respect of any defect arising from fair wear and tear, willful damage, negligence, abnormal working conditions or misuse. If you notify Discount Office of a valid claim for a breach of this warranty within the one year period, Discount Office will replace or repair the Product or refund the price of the Product, at Discount Office's discretion, but Discount Office shall have no other liability to you. This warranty does not extend to Products not manufactured by Discount Office. For such Products you will be entitled to the benefit of the manufacturer's warranty or guarantee, if any.
If a technology product develops a fault within 12 months of purchase from us, you will need to follow the manufacturer’s warranty instructions and we shall provide you with a telephone contact number for the manufacturer in order to confirm the nature of your fault and obtain a fault acknowledgement reference from them. Please note we are unable to accept technology returns without this reference. 8. Liability
Nothing in these Terms shall exclude or limit Discount Office's liability for fraud or for death or personal injury caused by its negligence or any other liability to the extent that the same may not be excluded or limited as a matter of law. Without prejudice to the previous sentence, Discount Office shall not be liable for any loss of income or profits or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by the negligence of Discount Office, its breach or non-performance or any of its obligations under these Terms or otherwise. These Terms set out the full extent of Discount Office' obligations and liabilities in respect of the sale of the Products. In particular there are no conditions, warranties or other terms, expressed or implied, as to satisfactory quality, fitness for a particular purpose or of any other kind whatsoever, that are binding on Discount Office except as specifically stated in these Terms. Any condition, warranty or other term concerning the sale of the Products, which might otherwise be implied into or incorporated within these Terms, whether by statute, common law or otherwise, is excluded to the fullest extent permitted by law. If you are a consumer the exclusion of terms implied by law will not apply to you.
9. Data Protection
The personal information you provide to Discount Office consists of your name, your postal and e-mail addresses, other contact details as well as order, delivery and billing information; it will be maintained as part of our customer records for the purposes of credit checking, direct marketing, orders delivery and product purchase history. You may also receive news and marketing offers from other Discount Office companies. This information will be stored, namely, on our centralised database in the United Kingdom. Discount Office may also need to make your records available to our professional advisors, such as lawyers, accountants, regulatory authorities or other governmental administrations located in the European Union. Discount Office may also monitor phone calls directed to our offices. You can contact Discount Office at Discount Office, Unit 30, Monckton Road Industrial Estate, Wakefield, West Yorkshire WF2 7AL at any time to see the information held about you and to ask us to make any necessary changes to remove or correct it - in which cases an official fee will be payable - or to object against any further use of your personal data by Discount Office for direct marketing purposes. Further information as to the right to protect your personal data is available from the Data Protection Registry in the United Kingdom. By entering into any agreement with Discount Office or providing Discount Office with personal data, you consent to the processing and transfer of such data in the manner and for the purposes described here above.
10. General
Discount Office shall not be liable to you for any loss or damage which you might suffer arising from Discount Office's delay in fulfilling or failure to fulfill any of its obligations under these Terms to the extent that such delay or failure is caused by any circumstance beyond Discount Office's reasonable control. If due to such circumstances or events Discount Office has insufficient stocks to meet all its orders, Discount Office may apportion available stocks between its customers at its sole discretion. These Terms and any terms appearing on any order form to which these Terms apply constitute the entire agreement between you and Discount Office relating to the Products. The failure of Discount Office or you to enforce any of these Terms does not constitute a waiver of that term and shall in no way affect the right later to enforce the term. The invalidity or unenforceability of any clause of these Terms shall not adversely affect the validity or enforceability of the remaining provisions. No amendment, variation or addition to these Terms shall be binding unless agreed to in writing by an authorised representative of Discount Office. Discount Office may transfer any contract with you concluded on these Terms or any of its rights or obligations under any such contract. These Terms will be construed in accordance with the laws of England and any disputes shall be settled by the English courts.
